“Subject To” stands for “…the acquired property remains subject to the existing financing (mortgage)…”. In a Sub To transaction, the investor who is acquiring the property does not make a cash purchase or a down payment. Instead, the seller deeds the property to the investor in return for the investor’s agreement to make the required future payments to pay off the seller’s existing mortgage.

Scott Horne is a long-time real estate attorney with Horne and Associates, PC in Dallas, Texas. He has been practicing law in Texas for more than 30 years.
